HB 5353 Summary

• Amends the Public Employment Relations Act to add financial management teams alongside emergency managers in provisions allowing rejection, modification, or termination of collective bargaining agreements.

• Expands prohibited subjects of bargaining for public school employers to include decisions on insurance policyholders, school year start dates, pupil contact time, school improvement committee composition, open enrollment, charter school authorization, and outsourcing of support services.

• Prohibits public school employers from bargaining over teacher placement decisions, performance evaluation systems, performance-based compensation methods, classroom observation procedures, and staffing decisions related to program reductions or position eliminations.

• Requires collective bargaining agreements entered after March 28, 2013 to include provisions allowing emergency managers or financial management teams to reject, modify, or terminate agreements under the Local Financial Stability and Choice Act.

• Takes effect 90 days after enactment and is contingent on passage of HB 5337.
