HB 5535 Summary

• Allows individuals 21 years of age or older to possess and reasonably use stun guns, which are otherwise prohibited under Michigan penal code section 224a.

• Permits peace officers, corrections employees, probation officers, court officers, bail agents, licensed private investigators, aircraft crew members, and private security police officers to possess and use devices with electro-muscular disruption technology when trained and authorized.

• Allows individuals with valid concealed pistol licenses to possess and use electro-muscular disruption technology devices if they receive training on the device's use, effects, and risks.

• Requires authorized dealers to verify purchaser identity, confirm valid concealed pistol license status, and provide training on the device at time of sale; violation is a misdemeanor punishable by up to 30 days imprisonment or $500 fine.

• Prohibits use of stun guns or electro-muscular disruption devices against another person except under circumstances that would justify lawful use of physical force; violation is a misdemeanor punishable by up to 2 years imprisonment or $2,000 fine.
