HB 5765 Summary

• Establishes a pilot program from the effective date through April 1, 2019 allowing the Secretary of State to waive license suspensions for violations of section 601d(1) (moving violation causing death) upon request and review of evidence.

• Permits the Secretary of State to make one of three determinations after reviewing an applicant's police report and documentation: suspension was warranted, suspension was not warranted (full reinstatement), or circumstances other than negligent actions contributed to the death (eligible for restricted license).

• Requires applicants to submit an application with police report copies and other requested documentation to participate in the pilot program.

• Mandates the Secretary of State prepare and submit a report analyzing the pilot program to relevant legislative committees no later than June 1, 2019.

• Modifies existing suspension language in section 319(2)(f) to reference the new pilot program provisions in subsection (25).
