Physicians and health facilities must provide information to patients before and after administering HIV tests.

General informed consent for medical care is sufficient for HIV testing without requiring a separate consent form, but providers must verbally or in writing inform patients that an HIV test will be performed and offer them an opportunity to decline.

Patients who decline HIV testing must have that decision documented in their medical record.

Health facilities may perform HIV tests without patient consent if occupational exposure occurs (for health professionals, first responders, or emergency medical personnel) or upon police request under specified circumstances.

If an HIV test result is positive, the health facility must inform the patient and provide counseling regarding HIV infection, AIDS, and referrals for treatment and services, effective March 28, 2019.
