MI HB6020

Establishes felony charges for persons with HIV who engage in vaginal or anal intercourse with specific intent to transmit HIV without first informing their partner.

Creates felony charges for persons with HIV who transmit the virus through vaginal or anal intercourse without disclosure, acting with reckless disregard.

Establishes misdemeanor charges (up to 1 year imprisonment or $1,000 fine) for persons with HIV who engage in vaginal or anal intercourse without disclosure and act with reckless disregard but do not transmit the virus.

Provides that persons with HIV who are adherent with their physician's treatment plan and medically suppressed per accepted medical standards are not acting with reckless disregard.

Takes effect 90 days after enactment into law.
