HB 6148 Summary

• Modifies supervision fee amounts for youthful trainees and probationers: reduces standard probation supervision fees from up to $135.00 per month to $30.00 per month, and electronic monitoring fees to $60.00 per month.

• Limits probation supervision fee collections to maximum of 36 months for youthful trainees and 60 months for general probationers, with caps adjusted based on whether electronic monitoring is used.

• Removes income-based fee determination tables and court discretion to assess higher fees based on probationer's financial resources, replacing with fixed monthly amounts.

• Allows courts to waive supervision fees if the supervised individual is determined to be indigent and permits monthly installment payments.

• Requires the State Court Administrative Office to adjust fee amounts annually beginning October 1, 2019, to ensure total collections do not fall below the prior fiscal year baseline.

• Effective 90 days after enactment, contingent on passage of HB 6149.
