Replaces terminology in MCL 333.5129 by changing references from "prostitution" and "prostitute" to "commercial sex acts" and "person to engage in a commercial sex act" throughout the Public Health Code section on STI and HIV testing.

Individuals arrested and charged with commercial sex act violations may be court-ordered to undergo examination or testing for sexually transmitted infections, hepatitis B and C, and HIV, with results reported to the defendant and appropriate health authorities for partner notification.

Judges must distribute STI and HIV information to individuals arrested for designated offenses and recommend voluntary counseling at local health department testing centers regarding STIs, hepatitis, HIV, and AIDS.

Upon bindover to circuit court for certain sex crimes, courts must order defendant examination or testing for STIs, hepatitis, and HIV, with victim-requested expedited testing within 48 hours if sexual penetration or body fluid exposure occurred, including mandatory follow-up testing and counseling.

Courts may order convicted individuals to pay actual and reasonable costs of examinations or tests, with failure to pay within 30 days constituting a misdemeanor punishable by up to 90 days imprisonment or $100 fine; bill takes effect 90 days after enactment and is contingent on enactment of HB 6169.
