Requires the department to provide public notice and a comment period before issuing permits, with specific analysis of disproportionate impacts on racial minority or low-income communities, air monitoring needs, and mitigation measures.

Mandates permit holders to either maintain a vegetative buffer (trees, shrubs, vegetation) between the facility and nearby residents or offer to purchase occupied dwellings at fair market value within 1,500 feet, with deed restrictions preventing residential use on purchased land.

Allows the department to increase the 1,500-foot distance on a case-by-case basis if necessary to protect public health and avoid disproportionate impacts on minority or low-income communities.

Requires the department to promulgate implementing rules within 1 year and makes the act effective 90 days after enactment.
