HB 6358 Summary

• Amends Michigan vehicle code sections 627 and 628 to establish statutory speed limits based on vehicular access point density, ranging from 15 mph in mobile home parks to 45 mph on highways with 30-39 access points per half-mile.

• Requires engineering and safety studies for modified speed limits to include documentation of proximity to schools, parks, and recreation centers, plus the number of children in surrounding communities, with findings made available to the public.

• Mandates public hearings before concluding engineering and safety studies for speed limit modifications, with speed limits set at the nearest 5 mph multiple to the 85th percentile of free-flowing traffic but not below the 50th percentile.

• Directs the state transportation department and department of state police to increase speed limits on at least 600 miles of limited access freeways to 75 mph and 900 miles of trunk line highways to 65 mph by January 5, 2018, if engineering studies support the increases.

• Takes effect 90 days after enactment and makes violations of speed limits civil infractions.
