HB 6461 Summary

• Amends 1961 PA 44 to modify pretrial release procedures for misdemeanor arrests by eliminating the interim bond system that allowed officers to set bonds.

• Requires arrested persons to be released on their own recognizance and provided a date for arraignment if a magistrate is unavailable or immediate trial cannot occur in a timely manner.

• Restricts detention to cases where the arrested person is under the influence of intoxicating liquor or controlled substances, wanted for another charge, unable to establish identity, or unsafe to release.

• Removes provisions allowing arrested persons to deposit interim bonds with arresting officers, supervisors, or jail personnel, instead requiring judicial determination of release conditions.

• Repeals sections 3, 4, 5, and 6 of 1961 PA 44 and takes effect 90 days after enactment, contingent on passage of HB 6463.
