HB 6471 Summary

• Amends the Estates and Protected Individuals Code to revise trust-related definitions including "qualified trust beneficiary," "discretionary trust provision," "trust protector," and "power of withdrawal."

• Establishes that a trust may be created for the care of a designated domestic animal alive during the settlor's lifetime, terminating upon the animal's death, with enforcement by a court-appointed person if needed.

• Creates a new category of noncharitable purpose trusts that may exist without a definite beneficiary and may operate for up to 25 years, with enforcement by a court-appointed person.

• Expands the definition of "qualified trust beneficiary" to include charitable organizations expressly named in charitable trusts and persons appointed to enforce animal care or noncharitable purpose trusts.

• Makes the bill contingent on the enactment of HB 6468 of the 99th Legislature.
