HB 6514 Summary

• Prohibits recording deeds or instruments containing restrictive covenants that discriminate based on race, sex, national origin, familial status, sexual orientation, gender identity, or disability.

• Declares such restrictive covenants void and unenforceable; courts and other persons are prohibited from enforcing them.

• Allows homeowners' and property owners' associations to amend governing documents by simple majority board vote to remove discriminatory covenants, and requires boards to amend documents upon written member request.

• Permits individual property owners to record amended deeds removing discriminatory restrictions without requiring consent from other parties.

• Authorizes property owners, occupants, tenants, or association board members to bring court actions to strike prohibited provisions from recorded deeds, and imposes liability on persons who refuse to remove such provisions before recording.
