Law enforcement officers seeking reemployment in Michigan must provide prospective employers with a signed waiver allowing the new employer to contact previous employers for separation records.

The Michigan Commission on Law Enforcement Standards must provide a standardized waiver form to all law enforcement agencies in the state.

Former employers must disclose separation records to prospective employers upon receipt of the signed waiver, and prospective employers cannot hire without receiving these records.

Former employers are immune from civil liability for good faith disclosure of separation records unless they knew the information was false, disclosed it recklessly, or violated state or federal statute.

The Michigan Commission on Law Enforcement Standards may request copies of separation records from law enforcement agencies to determine compliance with licensing standards.

The bill takes effect 90 days after enactment.
