Creates exemption from "home for the aged" licensing for facilities where room and supervised personal care providers are unrelated, or where related providers have maintained a 2+ year arrangement allowing residents to select their own care provider.

Establishes additional exemption for continuing care communities registered under the continuing care community disclosure act that include a licensed nursing home and allow residents to select their own supervised personal care provider.

Exemption under subsection (1)(a) or (b) expires December 31, 2019, except for successor owners who file required attestation; exemptions under subsection (2)(a) or (b) have no sunset date.

Requires facility owners to submit signed attestation to the department certifying exemption requirements are met, with $5,000 administrative fine penalty for false or inaccurate attestation; department must act on exemption applications within 60 days.

Allows department to revoke exemptions if false information was material to granting exemption, if negligence resulted in serious injury or death, or if facility owner fails to cooperate with department investigation; defines "supervised personal care" as direct guidance or hands-on assistance with activities of daily living.
