Changes language in Section 724 of the Michigan Vehicle Code from mandatory ("shall") to discretionary ("may") regarding civil fines for vehicle weight violations, allowing courts discretion in imposing penalties rather than requiring them.

Modifies civil fine structure for overweight vehicles: 3 cents per pound for excess up to 1,000 pounds; 6 cents per pound for 2,000-pound excess; 9 cents for 3,000-pound excess; 12 cents for 4,000-pound excess; 15 cents for 5,000-10,000 pound excess; and 20 cents per pound for excess over 10,000 pounds.

Establishes "misload" fines for improperly distributed loads: up to $200 per axle for 1,000-4,000 pound overage; up to $400 per axle for 4,000-8,000 pound overage; limits calculation to maximum of 3 axles.

Requires state transportation department and county road commission agents to operate clearly marked vehicles when stopping trucks on highways for weight inspections.

Takes effect 90 days after enactment into law.
