Senate Bill 508 Summary

• Prohibits persons from applying coal tar sealant or other high PAH (polycyclic aromatic hydrocarbon) sealant products on asphalt, concrete, or other pavement due to harmful effects on humans and aquatic life.

• Bans the sale of coal tar sealant or other high PAH sealant products in Michigan, except to purchasers who submit a completed "no-Michigan-use form" certifying the product will not be used within the state.

• Requires sellers to retain completed no-Michigan-use forms or written exemptions for 3 years and permit department inspection upon request.

• Allows the Director of Environmental Quality to grant written exemptions for research on environmental effects or development of alternative technologies, with use limited to that research or development.

• Establishes a civil fine of up to $5,000 for violations, with property owners rebuttably presumed liable for unauthorized sealant applications on their property; takes effect 90 days after enactment.
