Local governmental bodies cannot adopt ordinances, policies, or resolutions prohibiting property they sell, lease, or transfer from being used for lawful educational purposes by educational institutions or private schools, with exceptions for zoning ordinances and school site plan reviews.

Local governmental bodies are prohibited from imposing or enforcing deed restrictions that prevent property from being used for educational purposes, and any existing deed restrictions limiting educational use of previously educational property are void as of the amendment's effective date.

When offering property for sale, lease, or rent, local governmental bodies cannot refuse to transact with educational institutions or private schools solely because they intend lawful educational use, but are not required to prioritize such entities or provide special notice or right of first refusal.

Section 1260 of the revised school code (1976 PA 451) is repealed.

The act took effect immediately upon the Governor's approval on January 26, 2018.
