Mining permits issued by the department remain in effect until terminated or revoked, with termination allowed if the permittee has not commenced mining activities within 2 years or has completed final reclamation with department approval.

For significant permit amendments, the department may either submit the request through the full new permit application review process or hold a public meeting within 42 days, accepting written comments for 28 days before granting or denying within 14 days.

Non-significant permit amendments require only written notice to local governments, counties, and affected tribes, plus newspaper publication, with department approval granted within 14 days.

Permittees may request to relocate or reconfigure shafts, tunnels, surface facilities, or equipment without a full permit amendment if the changes occur within the permitted mining area and cause no subsidence or adverse environmental impacts.

Mining permit transfers to new operators require department approval after providing public notice, with the acquiring operator accepting existing permit conditions and resolving any violations through corrective action or written consent agreement.
