Schools must not be in session on the Friday before Labor Day until subsection (2) applies.

School districts, intermediate school districts, and public school academies cannot begin their school year before Labor Day (the first Monday in September).

Existing collective bargaining agreements with school calendars that do not comply with the Labor Day requirement are exempt until the agreements expire.

Year-round schools and international baccalaureate academies operating as of September 29, 2005 are exempt; schools beginning year-round operations after that date may apply to the superintendent of public instruction for a waiver.

Schools operating grades 6-12 at a single site with advanced placement curriculum ending concurrent with the advanced placement examination period are exempt from these requirements.
