Defines "co-occurring enhanced crisis residential program" as a department-approved program providing short-term intensive mental health and substance use disorder services with enhanced staffing and programming reviewed by the Department of Health and Human Services.

Allows adult foster care facilities licensed as both substance use disorder programs and approved as co-occurring enhanced crisis residential programs to operate without being excluded from the definition of adult foster care facilities.

Establishes that residents of co-occurring enhanced crisis residential programs are not considered to require continuous nursing care, allowing them to receive adult foster care services.

Clarifies that licensees providing foster care to hospice-enrolled residents with do-not-resuscitate orders or POST forms satisfy protection requirements by contacting the hospice program in the event of cessation of respiration and circulation.

Effective date: March 19, 2019 (90 days after enactment on December 19, 2018).
