Hospitals that accept health insurance payments and use a charge description master must post an electronic copy on their website beginning 180 days after enactment, or provide written/electronic copies at the hospital location if no website exists.

Hospitals must display clear notice in emergency departments, admissions offices, and billing offices informing patients that the charge description master is available as described.

Hospitals are prohibited from entering into contracts that prevent them from making their charge description master publicly available.

The Department of Licensing and Regulatory Affairs may impose administrative fines up to $1,000 per day for violations of this section.

Charge description master is defined as a uniform schedule of charges representing the hospital's gross billed charge for services or items regardless of payer type; bill takes effect 90 days after enactment and is contingent on passage of Senate Bill No. 966.
