SB 1088 Summary

• Prohibits sale, offering for sale, and distribution of nonflushable nonwoven disposable wipe products unless packaging includes "do not flush" labeling.

• Required "do not flush" label must include a prohibition logo (person dropping item in toilet with circle and diagonal line) and the word "nonflushable" in clear print, with logo size scaled to packaging dimensions (0.25 to 1 inch diameter).

• Label must be unobscured by seams or folds and permanently affixed in visible location when individual wipes are dispensed from packaging.

• Exempts products advertised in media or sold by retailers/wholesalers that do not package or label the products themselves.

• Violations subject to civil fines up to $5,000 per offense, with each day of continuing violation counted as a separate offense; Department of Environmental Quality enforces; takes effect 2 years after enactment.
