State agencies entering procurement contracts over $100,000 for computer-based work must require vendors to use qualified software to verify hours worked, effective October 1, 2018.

Vendors must store data collected by qualified software for 7 years after payment and provide retrieval to the state agency or auditors at no charge, with data remaining non-governmental property.

Qualified software must be approved by the department and include real-time or retroactive data access, automatic screenshots at least every 3 minutes, keystroke and mouse event tracking, automated cost status reporting, and professional biographical information on workers.

Qualified software must protect confidential personal information on individuals and allow the state agency to provide immediate feedback on work in progress.

Qualified software must be procured from an independent entity and vendors cannot charge the state or auditors for access to the software or data retrieval.
