Landfill owners or operators must pay a $5.00 per ton fee to the Department of Environmental Quality for TENORM (Technologically Enhanced Naturally Occurring Radioactive Material) disposed of in their landfills, with fractional tons charged proportionally.

Fees are calculated based on the quantity of TENORM reported on monthly operating reports and must be paid within 30 days after the end of each calendar quarter.

Creates a TENORM account within the environmental pollution prevention fund to receive fee revenue, with funds invested by the state treasurer and interest credited back to the account.

Collected fees may be expended for refunds to TENORM generators, departmental regulation and oversight of TENORM disposal, and grants to local governments and landfill operators for radiation monitoring equipment.

Takes effect 90 days after enactment, contingent on Senate Bill 1196 of the 99th Legislature being enacted into law.
