HB 4078 Summary

• Allows city hospitals established under the Home Rule Cities Act in cities with populations under 103,000 to be automatically incorporated as corporations under the Municipal Health Facilities Corporations Act without requiring a voter election or filing articles of incorporation.

• Permits automatic incorporation to occur without diminishing the terms of office of existing hospital board members, and allows the city council to later adopt formal articles of incorporation at any time.

• Provides that automatically incorporated hospitals are considered successors to the original city hospital, inheriting all property, rights, debts, and obligations while maintaining existing labor agreements and employee relationships.

• Permits cities with automatically incorporated hospitals to have the hospital board membership and appointment procedures governed by the city charter until formal articles of incorporation are adopted.

• Establishes an effective date of 90 days after enactment for these provisions regarding automatic incorporation of qualified municipal hospitals.
