Replaces civil infraction penalties for litter violations of 3 cubic feet or more with misdemeanor criminal penalties: first violation punishable by fine up to $2,500.00 for 3-5 cubic yards of litter, and up to $5,000.00 for 5 or more cubic yards.

Increases penalties for subsequent violations: second violation of 3-5 cubic yards subject to fine up to $5,000.00, with each additional violation increasing the fine by $2,500.00; second violation of 5+ cubic yards subject to fine up to $10,000.00, with each additional violation increasing by $5,000.00.

Applies criminal penalties to both the person committing the violation and their employer or employing agency if the violation is committed at the employer's direction or with the employer's knowledge.

Authorizes civil fines by city/township attorneys, county prosecutors, or the attorney general for actual cleanup and remediation costs, separate from or in lieu of criminal penalties, with fines directed to community groups or government departments performing the cleanup.

Requires courts to order violators to remove litter and remediate property damage as part of sentencing; establishes procedures for proving prior convictions to support enhanced penalties.
