Requires nonparticipating health care providers to disclose in writing to nonemergency patients at least 14 days before service (or at first contact for certain facilities) that the patient may be responsible for uncovered costs.

Mandates providers supply a good-faith cost estimate and obtain patient signature acknowledging receipt and understanding of the disclosure; providers must retain the disclosure for at least 7 years.

Prohibits providers from delivering the disclosure at time of hospital admission or immediately before surgery/medical procedures.

If a provider fails to provide required disclosure, they must submit claims to the patient's carrier within 60 days and accept the greater of: (a) the median negotiated amount for that region and specialty, or (b) 150% of the Medicare fee schedule, excluding in-network coinsurance, copayments, or deductibles.

Effective immediately upon enactment on October 22, 2020, contingent on simultaneous enactment of House Bills 4459, 4990, and 4991.
