HB 4606 Summary

• Requires persons procuring or collecting blood, tissues, organs, or specimens for transplantation, transfusion, or injection to test donors and specimens for HIV, HIV antibodies, and Lyme disease.

• Allows untested specimens to be used in emergency or exigent circumstances if the recipient and responsible medical personnel are informed and provide written consent.

• Prohibits use of specimens with positive test results except when donors provide blood exclusively for their own transfusion and both parties consent in writing after being informed of positive results.

• Requires testing of self-replicating body fluids (such as breast milk) for HIV and HIV antibodies at initial donation and every 3 months for regular donors.

• Defines positive HIV test results as double positive enzyme-linked immunosorbent assay combined with positive western blot, or other federally approved reliable test.
