HB4970 Summary

• Allows county road commissions, cities, and villages to enter into alternative contract delivery method agreements with private entities for design, development, financing, maintenance, or operation of highways, streets, roads, rights-of-way, or bridges under their jurisdiction, effective October 1, 2019.

• Limits county road commissions to alternative contract delivery method agreements totaling no more than 50% of their yearly section 12 distribution amount.

• Limits cities and villages to alternative contract delivery method agreements totaling no more than 50% of their yearly section 13 distribution amount.

• Requires private entities to assume all control and responsibility for the portions of infrastructure subject to alternative contract delivery method agreements, except as otherwise provided in the agreement.

• Defines "alternative contract delivery method agreement" as a written agreement between a public authority and a private entity, and "private entity" to include individuals, corporations, partnerships, limited liability companies, joint ventures, business trusts, nonprofit entities, and other business entities.
