MI HB4984

Allows individuals convicted of up to 3 felony offenses to apply to have all Michigan convictions set aside, with exceptions for certain violent crimes.

Limits applicants to setting aside no more than 2 assaultive crime convictions during their lifetime and no more than 1 felony conviction for the same offense if punishable by more than 10 years imprisonment.

Permits individuals convicted of human trafficking-related offenses (sections 448, 449, or 450 of the Michigan penal code) to petition for conviction set-aside if the offense was committed as a direct result of being a human trafficking victim.

Allows individuals convicted of section 520e violations (criminal sexual conduct) before January 12, 2015 to petition for set-aside if they have no subsequent convictions except up to 2 minor offenses with maximum 90-day imprisonment and $1,000 fine.

Takes effect April 11, 2021, contingent upon enactment of related bills HB 4980, 4981, 4982, 4983, 4985, and 5120.
