HB 5137 Summary

• Creates separate enhanced penalties for heroin, fentanyl, carfentanil, and their derivatives/mixtures, with sentences ranging from 10-20 years imprisonment for amounts under 50 grams up to life imprisonment for amounts of 1,000 grams or more.

• Establishes separate enhanced penalties for other opiates (excluding those listed above) classified in schedule 1 or 2, with sentences up to 10 years imprisonment for amounts under 50 grams and up to life imprisonment for amounts of 1,000 grams or more.

• Reduces maximum sentences for other schedule 1 or 2 narcotics: from life imprisonment to 30 years for amounts of 1,000 grams or more; from 30 years to 20 years for 450-999 grams; and from 20 years to 10 years for amounts under 50 grams.

• Allows terms of imprisonment for heroin, fentanyl, carfentanil, and other opiates to run consecutively with sentences for other felonies.

• Takes effect 90 days after enactment and is contingent on enactment of HB 5138.
