Allows HIV-positive organs to be transplanted into HIV-positive recipients if the recipient is informed of the positive test result and both the recipient and transplant physician agree in writing to the procedure.

Requires testing of blood, tissue, organs, and other specimens for HIV or HIV antibodies before use for transplantation or transfusion, with exceptions only for emergency situations when testing cannot be completed in time.

Permits use of untested specimens in emergencies only if both the responsible medical professional and recipient (or appropriate family members for minors) are informed in writing of insufficient testing time and agree to the procedure.

Allows individuals to use their own blood for autotransfusion if tested positive for HIV, provided both the responsible medical professional and recipient consent in writing after being informed of the positive result.

Requires persons ordering or performing HIV tests to inform donors of positive results; defines positive results as double positive ELISA combined with positive western blot or other federally reliable HIV tests approved by the department; takes effect 90 days after enactment.
