HB 5496 Summary

• Amends the definition of "existing coal ash impoundment" to clarify that impoundments receiving coal ash before December 28, 2018, that had not initiated closure activities are capable of receiving coal ash in the future and must obtain an operating license by December 28, 2020, to avoid being classified as an open dump.

• Modifies the definition of "lateral expansion" for coal ash landfills to specify that expansions beyond limits in construction permits issued after December 28, 2018, or horizontal expansions of existing coal ash landfills made after October 19, 2015, require new permits.

• Updates references to the "department of environment, Great Lakes, and energy" in the definitions section of Michigan's solid waste management law.

• Takes effect immediately upon enactment on May 15, 2020.
