HB 5510 Summary

• Repeals Part 222 of the Public Health Code (MCL 333.22201 to 333.22260), which established the certificate of need program requiring health facilities to obtain approval before major capital expenditures.

• Removes certificate of need requirements from health facility licensing and construction permit processes, eliminating the need for applicants to demonstrate community health needs before major projects costing $1,000,000 or more.

• Modifies Section 20145 to require only a one-page information sheet (instead of full certificate of need review) for construction permits over $1,000,000, with information made publicly available by the department.

• Eliminates all certificate of need-related fees and assessments previously collected under Section 20161, effective October 1, 2023.

• Makes technical corrections and definition updates throughout the Public Health Code to remove references to the repealed certificate of need program and clarify health facility licensing requirements, effective 90 days after enactment.
