• Establishes enhanced misdemeanor penalties (up to 1 year imprisonment or $1,000 fine) for second or subsequent violations of subsection (1) offenses.

• Creates separate misdemeanor offense with up to 1 year imprisonment or $1,000 fine for violations involving distribution to adults, recipient redistribution, coercion, or electronic storage on devices.

• Imposes felony penalties (up to 4 years imprisonment or $10,000 fine) for second or subsequent violations of the more serious offenses listed in subsection (2).

• Requires devices containing sexually explicit material of minors to be purged of such content before release to owner, or alternatively forfeited and destroyed at court discretion.
