Replace "shall" with "must" throughout section 409 of the Mental Health Code to modernize legislative language.

Expand preadmission screening unit criteria for hospitalization to include individuals who meet section 401(1)(a) to (c) standards and may qualify for assisted outpatient treatment as an alternative.

Require preadmission screening units to provide information about alternative services offered by the community mental health services program and attempt to arrange appropriate follow-up referrals when hospitalization is denied.

Add new requirement that if an individual refuses recommended hospitalization or treatment and no alternative service can be arranged, the preadmission screening unit must file a petition with the court alleging the individual requires treatment under section 401.

Clarify language regarding consultation with family members and decision-making authority for the executive director and medical director in second opinion cases.
