HB 5636 Summary

• Expands mandatory expunction of juvenile adjudications for human trafficking victims to include felonies, misdemeanors, and local ordinance violations (previously limited to specific Michigan Penal Code sections 448-450).

• Changes language throughout MCL 712A.18e from "shall" to "must" for consistency in statutory interpretation.

• Maintains existing eligibility requirements: applicants must wait 1 year after disposition or detention completion, cannot have more than 1 felony adjudication, and must satisfy court standards that circumstances warrant expunction.

• Preserves restrictions on expunction: offenses with life imprisonment maximums, traffic violations, and convictions under section 2d remain ineligible for setting aside.

• Effective 90 days after enactment.
