Changes references to "common prostitute" to "person engaged in commercial sexual activity" and updates related language throughout the Michigan penal code.

Modifies section 167 to replace outdated prostitution terminology with "commercial sexual activity" in provisions addressing disorderly persons who loiter in establishments where such activity occurs.

Updates section 520m to change DNA sampling requirements from references to "prostitution violations" to violations involving "detaining a person less than 16 years of age for purposes of commercial sexual activity" and renting property for "commercial sexual activity."

Replaces mandatory language ("shall") with "must" in sections 167(2) and 520m(6) and updates cross-reference language from "second offender or third and subsequent offender" to "person who was previously convicted."

Takes effect 90 days after enactment and is contingent on enactment of HB 5655.
