• Replaces outdated terminology in the DNA Identification Profiling System Act by changing references from "prostitution" to "commercial sexual activity" in statutes MCL 750.167, 750.451, and 750.454.

• Expands the list of misdemeanors requiring mandatory DNA sample collection and permanent retention to include violations related to commercial sexual activity and associated offenses.

• Requires written notification to individuals at the time of DNA sample collection regarding circumstances under which their sample or profile will be destroyed or expunged.

• Maintains the $60.00 assessment imposed on individuals convicted of or found responsible for qualifying offenses, with funds distributed to law enforcement agencies (25%) and the state justice system fund (65%).

• Takes effect 90 days after enactment and is contingent upon passage of Senate Bill No. ____ or House Bill No. 5655.
