• Changes motorboat operation restriction for children under 12 from "no more than 35 horsepower" to "not more than 35 horsepower" (clarifying language change).

• Removes requirement that persons born on or after July 1, 1996 operating motorboats with more than 6 horsepower be "subject to subsection (4)" before requiring a boating safety certificate.

• Adds civil infraction penalty of up to $150 for failing to present a boating safety certificate upon demand by a peace officer.

• Clarifies that displaying an electronic copy of a boating safety certificate does not constitute consent to search an electronic device.

• Provides liability protection to the state, state employees, peace officers, and their employers for damage to or loss of electronic devices occurring during inspection of boating safety certificates.
