HB 5814 Summary

• Establishes new financial assurance requirements for landfills and coal ash impoundments, creating two primary categories: those subject to bond and perpetual care fund requirements (Section 11523(1)(a)) and those subject to detailed cost estimate requirements (Section 11523(1)(b)).

• Increases maximum bond amounts from $1,000,000 to $2,000,000 and raises standardized closure cost estimates from $20,000-$25,000 per acre to $40,000-$50,000 per acre, with postclosure maintenance costs increasing from $200-$1,100 per acre annually to $400-$1,435 per acre annually.

• Creates new "landfill care fund" mechanism for certain landfills as alternative to perpetual care fund, allowing owners/operators flexibility in financial assurance methods while maintaining department oversight and access to funds for closure and corrective action.

• Increases surcharge rates for landfill disposal from 12 cents per cubic yard to 36 cents per ton and establishes separate lower rates for industrial waste materials; modifies surcharge payment schedules from annual to quarterly assessments.

• Takes effect 90 days after enactment and is conditioned on simultaneous passage of related bills HB 5812, HB 5813, HB 5815, HB 5816, and HB 5817.
