HB 5855 Summary

• Amends MCL 380.1599 to change the penalty for parents or guardians who fail to comply with compulsory attendance requirements from a misdemeanor punishable by a fine of $5-$50 or up to 90 days imprisonment to a misdemeanor punishable by a fine of $5-$50 or imprisonment for not more than 90 days.

• Amends MCL 380.1809 to establish penalties for fraudulent use of teaching certificates, school administrator certificates, or state board approvals, with first offense punishable by up to 93 days imprisonment or a fine up to $500, and subsequent offenses by up to 6 months imprisonment or a fine of $500-$1,000.

• Adds penalties for fraudulent use of college or university transcripts and credentials to obtain teaching or administrator certificates, with the same first offense (up to 93 days or $500 fine) and subsequent offense (up to 6 months or $500-$1,000 fine) structure.

• Authorizes the state board of education to refuse to issue, renew, or endorse teaching certificates, school administrator certificates, or state board approvals for persons convicted of violations under section 1809.

• Effective date: March 24, 2021.
