HB 5930 Summary

• Health facilities and emergency care agencies must develop a policy by December 31, 2020 for medical resource allocation during declared emergencies related to public health.

• Policies must enable clinical decision-making based on objective medical evidence and individualized patient assessment, while prohibiting discrimination based on age, disability, race, socioeconomic status, immigration status, criminal history, and 16 other protected characteristics.

• Policies must coordinate with the Department of Health and Human Services regarding resource and transfer availability, and ensure withholding or delaying care is always a last resort.

• Health facilities must make their policies publicly available upon request and post them on their website whenever the policy is in effect.

• The Department may promulgate rules to implement the requirements in consultation with the Department of Health and Human Services.
