HB 5931 Summary

• Requires consumer fireworks retailers to display a conspicuous sign at retail locations describing limitations on hours of use, restrictions on using fireworks on others' property, prohibitions on sales to minors, restrictions on use while intoxicated, and liability for injuries or property damage.

• Mandates retailers provide written notice with every fireworks purchase listing the dates and times permitted for ignition and use under state law, which may be provided on receipts, bags, product packaging, or printed handouts.

• Establishes civil fines of up to $2,500 per violation for noncompliance with retail location requirements, with each day of noncompliance constituting a separate violation.

• Requires retailers to maintain public liability and product liability insurance coverage of at least $10,000,000 per occurrence during sales periods, with violations subject to cease-and-desist orders and fines up to $5,000.

• Takes effect 90 days after enactment, contingent upon passage of Senate Bill ____ or House Bill 5932 during the 100th Legislature.
