HB 6007 Summary

• Allows mobile home park owners to declare a mobile home abandoned after obtaining a court order restoring possession and either 90 days of continuous vacancy or 10 days of unpaid rent following that order.

• Requires park owners to provide written notice of intent to abandon to the mobile home owner, all lease agreement parties, and lienholders via certified mail, and file the notice with the secretary of state.

• Mobile home owners or lienholders have 30 days after secretary of state notice to remove the mobile home; liens are extinguished if the home remains after 30 days.

• Park owners must calculate fair market value and notify owners they are entitled to compensation equal to fair market value minus unpaid rent, fees, and utilities owed to the park.

• Park owners can apply to the secretary of state for title transfer after 30 days if requirements are met; title issued after 10 days and is free of liens if lienholders received certified notice.
