HB 6213 Summary

• Amends Michigan's sentencing guidelines in the Code of Criminal Procedure to add a new offense variable 34 called "disengagement from crime."

• Allows courts to reduce a defendant's offense variable score by up to 5 points if evidence shows the defendant attempted to disengage from a crime after it was planned or begun but before completion.

• Allows courts to reduce the offense variable score by up to 10 points if the defendant warns a victim, shields a potential victim from harm, or alerts others causing codefendants to stop criminal actions.

• Requires offense variable 34 to be scored after all other offense variables (1-20) have been scored, when applicable to the facts of the case.

• Effective date is 90 days after enactment.
