HB 6215 Summary

• Amends Michigan's sentencing guidelines (MCL 777.22) to add a new discretionary offense variable 21 for acceptance of responsibility in criminal sentencing.

• Allows courts to reduce a defendant's offense variable score by up to 5 points if the defendant pleads guilty before trial to the charged offense or a prosecution-offered reduced/amended charge.

• Allows courts to reduce a defendant's offense variable score by up to 5 points if the defendant apologizes to a victim and that victim requests the court to reduce the defendant's score.

• Creates new section 49b establishing that offense variable 21 must be scored after all other offense variables (1-20) and applies to all crimes where applicable at the court's discretion.

• Takes effect 90 days after enactment into law.
