HB 6220 Summary

• Amends Michigan's criminal sentencing guidelines (MCL 777.22) to add offense variable 22, which courts may score at their discretion for crimes where rehabilitation evidence is applicable.

• Courts may reduce a defendant's offense variable score by up to 5 points if the defendant is actively seeking and receiving mental health treatment.

• Courts may reduce a defendant's offense variable score by up to 10 points if the defendant is receiving mental health treatment and presents strong evidence of taking actions to address mental health issues.

• Offense variable 22 must be scored after all other offense variables (1-20) have been scored and applies only to crimes where it is factually applicable.

• Takes effect 90 days after enactment.
