HB 6223 Summary

• Amends the Michigan Code of Criminal Procedure to add offense variable 29 relating to victim-offender mediation as a discretionary sentencing factor.

• Courts may score offense variable 29 after scoring all other offense variables (1-20) when applicable to the facts of a case.

• Allows courts to reduce a defendant's offense variable score by 5 points if the defendant actively participated in a prosecutor-approved mediation process with the victim or victims.

• Allows courts to reduce a defendant's offense variable score by 10 points if the victim or victims request the reduction at the conclusion of a prosecutor-approved mediation process.

• Takes effect 90 days after enactment into law.
