HB 6233 Summary

• Adds definition of "sell" or "selling" for new motor vehicles to include engaging in business of selling, trading, leasing, or offering for sale or lease at retail.

• Prohibits manufacturers from authorizing non-franchised service facilities to perform warranty repairs and recall work, with limited exceptions for emergency service, manufacturer-owned facilities, and fleet operator vehicles.

• Expands manufacturer prohibitions to include owning service and repair facilities, except for repairs of manufacturer-owned vehicles and fleet operator vehicles upon request.

• Repeals Section 17a entirely, which previously established procedures for dealers to declare retail parts markups and labor rates and dispute manufacturer challenges to those rates.
